After more than two years of litigation, including a Markman hearing and summary judgment briefing, b-50.com, LLC of Golden Valley, Minn. (b-50) is pleased to announce it has settled a patent infringement lawsuit it brought in 2004 against XFormity, Inc., a Dallas company. The settlement includes payment of license fees from Xformity to b-50, and allows XFormity to continue to develop and sell above-store reporting tools to its restaurant customers. In reaching the settlement, both b-50 and XFormity acknowledge the continuing presumption of validity of b-50's patent. The b-50 patent is directed to a method of generating internet reports based on restaurant point-of-sale data transferred between multiple remote computing devices and a central computing device. B-50 asserted that XFormity's QSRx restaurant-reporting product infringes on its patent. Bruce Clark, CEO of b-50 was pleased with the settlement. "The settlement allows both b-50 and XFormity to profit from the patented technology, while allowing both companies to continue providing services to their clients," said Clark. He added "This patent is a valuable part of b-50's intellectual property portfolio, and we will continue to use the intellectual property to develop our business."
